2009-12-doc9 Lisbon Treaty

The Lisbon Treaty came into force 1 December 2009. For European Insolvency Law two interesting items emerge: (i) the EC Court of Justice now is formally called Court of Justice of the European Union ("EUJ"), and (ii) also lower courts when confronted with queries of interpretation are now allowed to refer questions to the EUJ, which was until now only a possibility for a member state's supreme court.  EUJ press release In a new Title IV, Chapter III ("Judicial cooperation in civil matters" one may expect to find a more proper basis for further strengthening the positions of courts (training; cross-border cooperation).
